Terms, plainly.

How the website works. How we work together. What each side can expect.

About these terms

These terms govern your use of this website and explain, in plain language, how EmanuelRad engagements generally work. By using the website you agree to them. If you do not agree, please do not use the website.

Paid work is governed by a written agreement, proposal or statement of work that we both accept. If it conflicts with these terms, that agreement controls. Nothing on this website is an offer that you can accept by browsing or submitting a form.

Using the website

You may use this website to learn about our services and to contact us. Please do not misuse it: no attempts to disrupt or probe its security, no automated scraping that burdens the service, no false or misleading submissions, and no unlawful use.

Information on this website, including service descriptions, example pricing, “typically from” figures, turnaround ranges and comparisons, is for general information. It is not a quote, a guarantee or professional advice. A price or scope only applies once we confirm it in writing.

Inquiries and sessions

Submitting an inquiry or a fit check does not create a client relationship, an obligation to take on your work or an obligation for you to buy. The Get Started chooser offers a suggestion, not a binding decision.

Working sessions are scheduled by agreement. We will agree a time and the fee before anything is charged. Where a Review or Strategy session is paid and you start a subscription or project within 30 days, its fee is credited toward your first month or project deposit, once per client. Direction Sessions are not credited.

Subscriptions and plans

Subscriptions are billed monthly in US dollars. The first two months are an initial commitment, then the plan continues month to month. After the initial period you can cancel with 30 days’ notice. Work in progress during the notice period is finished or handed over with source files.

After the first two months you can pause once in any 12 months, for up to one month, with 14 days’ notice. You are not billed while paused, and work typically restarts within five business days, with the same team where possible.

Plans are defined by work in progress, so unused capacity does not carry over. A 12-month agreement locks your monthly rate for the year with a quarterly review. We do not offer billing discounts. Some plans are by application or in early access, and we may decline or waitlist a request.

Projects, revisions and timing

Projects are quoted and agreed in writing before work begins, with scope, deliverables, fees and payment schedule. Revision rounds continue within the agreed brief. A new direction or a change of scope is a new request and may be priced separately.

Turnaround times are typical ranges and not guarantees. Timing depends on prompt feedback, approvals and materials from you. We are not responsible for delays caused by late input or by third parties.

Fees, payment and refunds

Fees are stated in US dollars and exclude any applicable taxes unless we say otherwise. Invoices are due by the date shown. We may pause work on an overdue account after notice.

Fees for work already delivered or in progress, and for a billing month already started, are not refundable. Subscription pauses are handled as described above. Nothing here limits any refund or cancellation right that applicable law gives you.

Ownership and licenses

Unless your agreement says otherwise, final deliverables and their source files transfer to you once the related fees are paid in full. Until then we keep ownership of them and you may not use them publicly.

Third-party materials such as stock assets, fonts and software are licensed under their own terms, and we will tell you where a license affects how you can use a deliverable. We keep our pre-existing tools, methods and templates.

We may show finished work in our portfolio and case studies only where permitted by your agreement or your written approval. You can ask us to omit or remove your work, and we will treat client confidential information as confidential.

AI-assisted production

We may use AI tools to support research, exploration and production, always under human direction and review. We do not put confidential client information into tools that train on that input. Ownership of AI-assisted output, and any limits on it, will be addressed in your agreement.

Your responsibilities

You confirm that you have the right to give us any materials you provide, that they do not infringe anyone else’s rights, and that the information you give us is accurate. You are responsible for the legal and regulatory review of your own content, including claims made in regulated areas such as finance and health.

Warranties and liability

The website and its information are provided as they are. To the fullest extent permitted by law, we disclaim implied warranties and do not guarantee specific business results, rankings, conversions or revenue.

To the fullest extent permitted by law, we are not liable for indirect, incidental or consequential damages, and our total liability for a claim relating to the website or to services is limited to the fees you paid us for the services in the three months before the claim arose. Nothing here limits liability that cannot be limited by law.

Governing law and changes

These terms are governed by the laws of the State of California, without regard to conflict-of-law rules, and disputes will be handled in the state or federal courts located in Orange County, California, unless your written agreement says otherwise.

We may update these terms from time to time. The version on this page, with its effective date, applies to your use of the website. Continued use after an update means you accept it. A change does not alter a signed agreement unless both of us agree.
